According to the provisions of the Law no. 105 of 09.06.2017, valid starting with June 30, 2017, the construction of the Ungheni-Chisinau gas pipeline has been declared utility of public interest.
In conformity with the Law no. 105, subject of expropriation are land plots in public property and in the property of territorial-administrative units: the city of Chisinau, the communes Stauceni, Tohatin and Ghidighici, Grătiești village (Chișinău); the villages Roșcani, Sireți, Negrești, Capriana, Vorniceni, the communes Rădeni, Ghelăuza, Pănășești and the village Bucovăț (Strășeni district); the commune Tuzara, the villages Pitușca, Nișcani, Peticeni, Vălcineț, Temeleuți, Sadova and Calarasi town (Călărași); Milești village (Nisporeni);, communes Alexeevca, Pîrlița, Todirești, Zagarancea and the village Rădenii Vechi (Ungheni).
The expropriation will be temporary for portions of land affected by the construction works, and permanent, only for those lands on which surface infrastructure objects shall be built, such as measuring stations, dispatch centre, valves nodes etc.
Payment of damages shall be made after identifying affected plots, evaluating amounts due as compensation for damages, submittal of proposals for expropriation, set-up of the Disputes Settlement Commission, approval of expropriation decision/act with lists of land transmitted in the State property/temporary use etc.
The owners of the land affected by the construction works in accordance with the detailed design, as well as other legal rights’ holders will carry out the formalities relating to expropriation (will present documents confirming ownership rights/other rights over the land), will allow access to the Expropriator or other entities involved in the construction of the pipeline in the land affected by the construction works, and will inform the Expropriator on the existence of other rights’ holders on the object of expropriation.
Claims against the proposals for expropriation will be collected by the entity responsible for it on behalf of the Expropriator – Moldova Energy Projects Implementation Unit (MEPIU) for eventual transmittal to the Disputes Settlement Commission.
People who do not have the necessary documents (confirmation of ownership/other rights over the land) or who, due to objective circumstances, have not requested compensation of damages, shall be entitled to inform the MEPIU on the situation described, and request clarifications on the compensation procedure.
